Geltungsbereich<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Die folgenden Allgemeinen Gesch\u00e4ftsbedingungen (AGB) regeln das Vertragsverh\u00e4ltnis zwischen<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>Manuela Landenhammer<\/strong><br>Ganzheitlicher Kinder-, Jugend- und Familiencoach<br>Mozartstra\u00dfe 11a<br>84539 Ampfing<br>E-Mail: ML-Coaching@mail.de<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">\u2013 nachfolgend \u201eAnbieterin\u201c \u2013<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">und<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">dem Kunden (Teilnehmer an Kursen, Workshops, Coachings sowie K\u00e4ufer von Waren).<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Abweichende Bedingungen des Kunden werden nicht anerkannt, es sei denn, die Anbieterin stimmt ihrer Geltung ausdr\u00fccklich schriftlich zu.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Mit Anmeldung, Buchung oder Bestellung erkennt der Kunde diese AGB an.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>2. Vertragsgegenstand<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Die Anbieterin bietet folgende Leistungen an:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-small-font-size\">Kurse, Workshops und Coachings (Dienstleistungen)<\/li>\n\n\n\n<li class=\"has-small-font-size\">Verkauf von Waren (z. B. Materialien, Produkte)<\/li>\n<\/ul>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Die konkreten Leistungen ergeben sich aus dem jeweiligen Angebot.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>3. Vertragsschluss<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>3.1 Dienstleistungen (Kurse, Workshops, Coachings)<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Die Anmeldung erfolgt per E-Mail oder telefonisch. Der Vertrag kommt mit Zugang der Anmeldebest\u00e4tigung zustande.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>3.2 Warenbestellungen<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Die Darstellung der Produkte stellt kein rechtlich bindendes Angebot dar.<br>Mit der Bestellung gibt der Kunde ein verbindliches Angebot ab. Der Vertrag kommt mit Bestellbest\u00e4tigung zustande.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>4. Preise und Zahlungsbedingungen<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Alle angegebenen Preise sind Gesamtpreise.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Folgende Zahlungsarten stehen zur Verf\u00fcgung:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-small-font-size\">Vorkasse (Bank\u00fcberweisung)<\/li>\n\n\n\n<li class=\"has-small-font-size\">PayPal <\/li>\n<\/ul>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Sofern nichts anderes vereinbart ist:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-small-font-size\">Dienstleistungen sind\u00a0<strong>vor Beginn<\/strong>\u00a0zu bezahlen<\/li>\n\n\n\n<li class=\"has-small-font-size\">Waren sind\u00a0<strong>innerhalb von 7 Tagen nach Bestellbest\u00e4tigung<\/strong>\u00a0zu bezahlen<\/li>\n<\/ul>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Erfolgt kein Zahlungseingang, beh\u00e4lt sich die Anbieterin vor, vom Vertrag zur\u00fcckzutreten.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>5. Teilnahmebedingungen (Dienstleistungen)<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Ein Anspruch auf Teilnahme besteht nur nach vollst\u00e4ndigem Zahlungseingang.<br>Die Platzvergabe erfolgt in der Reihenfolge der Zahlungseing\u00e4nge.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>6. Widerrufsrecht<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>6.1 F\u00fcr Dienstleistungen<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Verbraucher haben das Recht, binnen 14 Tagen ohne Angabe von Gr\u00fcnden den Vertrag zu widerrufen.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Die Frist beginnt mit Vertragsschluss.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>Hinweis:<\/strong><br>Das Widerrufsrecht erlischt vorzeitig, wenn die Dienstleistung vollst\u00e4ndig erbracht wurde oder der Kurs bereits begonnen hat und der Teilnehmer ausdr\u00fccklich zugestimmt hat.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Der Widerruf ist zu richten an:<br>Manuela Landenhammer, Mozartstra\u00dfe 11a, 84539 Ampfing<br>E-Mail: ML-Coaching@mail.de<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>6.2 F\u00fcr Waren (Widerrufsbelehrung)<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>Widerrufsrecht<\/strong><br>Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gr\u00fcnden diesen Vertrag zu widerrufen.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Die Frist betr\u00e4gt vierzehn Tage ab dem Tag, an dem Sie oder ein benannter Dritter die Ware in Besitz genommen haben.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>Widerruf aus\u00fcben:<\/strong><br>mittels eindeutiger Erkl\u00e4rung (Brief oder E-Mail).<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>Folgen des Widerrufs:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-small-font-size\">Erstattung aller Zahlungen inkl. Versand und Eigentumsvorbehalt<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Der Versand erfolgt innerhalb von 2\u20133 Werktagen nach Zahlungseingang.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Die Versandkosten werden im Bestellprozess angegeben.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Die Ware bleibt bis zur vollst\u00e4ndigen Bezahlung Eigentum der Anbieterin.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>8. Stornierung und Absagen (Dienstleistungen)<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>8.1 Stornierung durch den Kunden<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\" style=\"font-style:italic;font-weight:100\">Kurse und Workshops <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-small-font-size\">bis 14 Tage vor Beginn: kostenfrei<\/li>\n\n\n\n<li class=\"has-small-font-size\">bis 7 Tage vor Beginn: 50 % der Geb\u00fchr<\/li>\n\n\n\n<li class=\"has-small-font-size\">danach: 100 % der Geb\u00fchr<\/li>\n<\/ul>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\" style=\"font-style:italic;font-weight:100\">Fortbildungen<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Mit Ihrer schriftlichen Zusage wird der vereinbarte Termin verbindlich f\u00fcr Ihre Einrichtung reserviert.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Ich halte diesen Termin exklusiv f\u00fcr Sie frei und beginne zeitnah bereits mit der individuellen Vorbereitung der Fortbildung.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Falls etwas dazwischenkommt<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Eine dringende Terminverschiebung ist nach Absprache und je nach Verf\u00fcgbarkeit gerne m\u00f6glich.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Sollte eine Fortbildung abgesagt werden m\u00fcssen, gelten folgende Stornierungsbedingungen:<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Zeitpunkt der Absage<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Ausfallhonorar<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-small-font-size\">mehr als 8 Wochen vorher 0 %<\/li>\n\n\n\n<li class=\"has-small-font-size\">8 bis 4 Wochen vorher 30 %<\/li>\n\n\n\n<li class=\"has-small-font-size\">weniger als 4 bis 2 Wochen vorher 50 %<\/li>\n\n\n\n<li class=\"has-small-font-size\">weniger als 2 Wochen bis 7 Tage vorher 80 %<\/li>\n\n\n\n<li class=\"has-small-font-size\">7 Tage oder weniger vorher 100 %<\/li>\n<\/ul>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Die Stornierung erfolgt bitte in Textform (z. B. per E-Mail an ML-Coaching@mail.de).<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Bereits konkret angefallene, nicht anderweitig vermeidbare Kosten k\u00f6nnen zus\u00e4tzlich berechnet werden.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Bei einer Terminverschiebung auf einen gemeinsam vereinbarten Ersatztermin innerhalb von 6 Monaten f\u00e4llt kein Ausfallhonorar an, sofern die Verschiebung rechtzeitig erfolgt und der neue Termin meiner Verf\u00fcgbarkeit entspricht.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Dem Auftraggeber bleibt der Nachweis vorbehalten, dass durch die Absage kein oder ein wesentlich geringerer Schaden bzw. Aufwand entstanden ist.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Ein Ersatzteilnehmer kann gestellt werden.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>8.2 Absage durch die Anbieterin<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Die Anbieterin kann Veranstaltungen absagen, insbesondere bei:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-small-font-size\">Nichterreichen der Mindestteilnehmerzahl<\/li>\n\n\n\n<li class=\"has-small-font-size\">Krankheit \/ Ausfall<\/li>\n\n\n\n<li class=\"has-small-font-size\">h\u00f6herer Gewalt<\/li>\n<\/ul>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Bereits gezahlte Geb\u00fchren werden vollst\u00e4ndig erstattet.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>9. \u00c4nderungen von Veranstaltungen<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">\u00c4nderungen von Zeit, Ort oder Durchf\u00fchrung sind zul\u00e4ssig, soweit sie f\u00fcr den Kunden zumutbar sind.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>10. Teilnahmeverhalten<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Teilnehmer haben den Anweisungen der Kursleitung Folge zu leisten.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Die Anbieterin kann Teilnehmer bei:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-small-font-size\">St\u00f6rung<\/li>\n\n\n\n<li class=\"has-small-font-size\">unangemessenem Verhalten<\/li>\n<\/ul>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">von der Teilnahme ausschlie\u00dfen.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>11. Urheberrecht<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Alle ausgegebenen Unterlagen sind urheberrechtlich gesch\u00fctzt.<br>Vervielf\u00e4ltigung oder Weitergabe nur mit schriftlicher Zustimmung.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>12. Coaching-Hinweis<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Coaching ersetzt keine medizinische oder therapeutische Behandlung.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Eine Erfolgsgarantie wird nicht gegeben.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>13. Haftung<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Die Anbieterin haftet:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-small-font-size\">uneingeschr\u00e4nkt bei Vorsatz und grober Fahrl\u00e4ssigkeit<\/li>\n\n\n\n<li class=\"has-small-font-size\">bei Verletzung von Leben, K\u00f6rper oder Gesundheit<\/li>\n<\/ul>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">F\u00fcr einfache Fahrl\u00e4ssigkeit nur bei Verletzung wesentlicher Vertragspflichten.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">Eine weitergehende Haftung ist ausgeschlossen.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>14. Haftung f\u00fcr Sachsch\u00e4den<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\">F\u00fcr Sch\u00e4den an Eigentum der Anbieterin oder R\u00e4umlichkeiten haftet der Teilnehmer bzw. dessen Erziehungsberechtigte.<\/p>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>15. Schlussbestimmungen<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-small-font-size\">Es gilt deutsches Recht<\/li>\n\n\n\n<li class=\"has-small-font-size\">Gerichtsstand ist, soweit zul\u00e4ssig, der Sitz der Anbieterin<\/li>\n\n\n\n<li class=\"has-small-font-size\">Sollten einzelne Bestimmungen unwirksam sein, bleibt der Vertrag im \u00dcbrigen wirksam<\/li>\n<\/ul>\n\n\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong>16.
